Out Of State Dui


The State of California draws a tremendous amount of tourists and visitors each year, many of whom decide to make California their new home. However, before such individuals get a chance to obtain a California State license, and find themselves facing a DUI charge, having an out of state license creates a few complicated issues with the law. Even though you may have an out of state license, if you are arrested for driving under the influence of alcohol or drugs in California, your right to drive in the state will be suspended within 30 days. (California residents who are arrested for DUI may have their license suspended or revoked unless they appeal such consequences within 10 days of their arrest.) After this occurs, the California Department of Motor Vehicles (DMV) will be notified of your DUI. Similar to a California resident, as an out of state driver, you have 10 days following your arrest to challenge your license suspension which will be heard at a DMV hearing.

Another factor of an out of state DUI in California that many motorists are unaware of is the existence of the American Association of Motor Vehicle Administrators. States that are a part of this organization will inform each other of DUI arrests that take place involving out of state residents. As a consequence of being arrested for driving under the influence in California, an out of state driver may encounter additional consequences with his or her home-state relating to his or her driver’s license and other legal matters.
