In California, any individual who, with the intent to perform theft, enters an inhabited building or a motor vehicle whose doors are locked has committed burglary. It is the State’s responsibility to prove that the defendant had intent to steal or commit a crime when entering the location. There does not need to be any evidence showing that the defendant actually committed a crime.

First degree burglary is a felony offense in the State of California. If convicted of first degree burglary, the defendant will serve up to six years in prison and a strike on his or her criminal record. California Penal Code Section states that: “Every burglary of an inhabited dwelling house, vessel, as defined in the Harbors and Navigation Code, which is inhabited and designed for habitation, floating home, as defined in subdivision (d) of Section 18075.55 of the Health and Safety Code, or trailer coach, as defined by the Vehicle Code, or the inhabited portion of any other building, is burglary of the first degree.”

Second degree burglary is a crime that may be a considered a misdemeanor or a felony, depending upon the circumstances of the specific case. The penalty associated with a second degree burglary may include a one year prison term.
